End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and FXzio Tools ("Company") governing your use of the FXzio Plus mobile application ("App"). By installing, accessing, or using the App, you agree to be bound by the terms of this Agreement.

1. License Grant Subject to the terms and conditions of this Agreement, the Company grants the User a limited, non-exclusive, non-transferable license to use the App solely for personal, non-commercial purposes.

2. Use of the App The User agrees to use the App only in accordance with applicable laws, regulations, and this Agreement. The User acknowledges that the App is intended solely for monitoring purposes and agrees not to modify, adapt, reproduce, distribute, or create derivative works based on the App.

3. Account Credentials

The User acknowledges that access to the App requires valid account credentials provided by the Company. The User agrees to keep their account credentials confidential and to notify the Company immediately of any unauthorized use of their account.

4. Data Privacy The User acknowledges that the App may access and display data related to their FXzio account. The Company assures the User that no personal data will be collected through the App, except for the optional upload of a profile image. The User retains ownership of any data uploaded to the App, and the Company will not share such data with any third party outside of the Company.

5. Intellectual Property The User acknowledges that the App and all intellectual property rights therein are owned by the Company. The User agrees not to remove, obscure, or alter any proprietary rights notices contained in the App.

6. Disclaimer of Warranty The App is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability In no event shall the Company be liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising out of or in connection with the use or inability to use the App, even if the Company has been advised of the possibility of such damages.

8. Termination This Agreement is effective until terminated by either party. The Company reserves the right to terminate this Agreement and revoke the User's access to the App at any time without prior notice or liability.

9. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflicts of law provisions.

10. Entire Agreement This Agreement constitutes the entire agreement between the User and the Company concerning the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
